Canal Update  March 2007
                   
At the Special Meeting held on March 9, 2007, The Association Board voted to pursue
the culverting of the canal running along the western boundary of Butler Farms.  The
cost of the project as estimated by our engineer falls within the budget anticipated as
part of the current special assessment.  The following schedule outlines our tasks,
(included in the Addendum to Stipulated Settlement Agreement), which was submitted
to the City and the Special Master and was accepted by both.  Our engineer is
currently preparing design drawings so that the project can be put out for bid.

Task 1.  RESPONDENT shall engage the services of an engineer on or before
December 4, 2006.  RESPONDENT shall obtain approval of the conceptual plan and
notify CITY of the selected conceptual plan on or before March 9, 2007.  In addition,
on or before March 9, 2007, RESPONDENT shall advice CITY as to whether an
adjustment may be required to the schedule.
Task 2.  REPSONDENT shall perform Geotechnical Engineering Services and
Structural Assessment within thirty (30) calendar days from the date of the execution
of this Addendum (on or before April 14, 2007).
Task 3.  RESPONDENT shall prepare Civil Engineering Design and Plans within ninety
(90) calendar days after performing the Geotechnical Engineering Services and
Structural Assessments (to be completed no later then July 13, 2007).
Task 4. RESPONDENT shall obtain permitting approval within one hundred and twenty
(120) calendar days after preparing the Civil Engineering Designs and Plans (to be
completed no later than November 10, 2007).
Task 5.  RESPONDENT shall complete the construction of the culvert sixty (60)
calendar days after obtaining permitting approval (no later than January 9, 2008).
Task 6.  RESPONDENT shall complete permit closure, including final approval by CITY,
within forty-five (45) calendar days after the completion of the construction of the
culvert.  This shall include, but is not limited to submittal of as-built surveys,
engineering certifications and agency acceptance (no later than February 22, 2008).

Canal Update September 2007

Task 2, Geotechnical Engineering Services and Structural Assessments, performed
by CAPRI Engineering was completed on May 3, 2007.  The intent of this investigation
was to determine the impact canal reconstruction and the removal of bridges,
retaining walls and fences will have on the existing 24 homes located east of the
drainage canal.  

Twelve (12) SPT borings were performed to depths of 10 feet and 15 feet below
ground surface.  (More specific information on this field exploration can be viewed
at our monthly meeting via the vice president).

On May 8, 2007, CAPRI Engineering inspected the 24 homes adjacent to the canal.  
The scope of the inspection was to check the apparent signs of possible structural
defects due to the drainage canal.    Based on the structural inspections, it appears
that there was minimal impact on the structural integrity of the homes from the
construction of the drainage canal.  (More specific information on these findings and
conclusions can be viewed at our monthly meeting via the vice president).

Task 3, Preparation of Civil Engineering Design and Plans was completed on July 13,
2007.  These plans are available for viewing at our monthly meetings.

Task 4, Obtaining permitting approval of Civil Engineering Design and Plans with
Florida Department of Environmental Protection / Pine Tree Water Control District
has been submitting and we are awaiting approval from these departments.
CANAL UPDATE AS OF DECEMBER 2007

Task 4 out of 6 was to complete the permit approval.  As of this date we are still awaiting on
the approval from Pine Tree Water Control District.  Once we gain this approval our
engineering firm will be moving forward with the construction of the culverting.

We have received approval from:

Broward County EPD issued a General License No. CSP-0710-033 on October 17, 2007

Broward County Environmental Protection Department stamped the plans on November 2,
2007

The City of Coral Springs approved Permit No. 07-9505 on November 14, 2007

We are still awaiting approval from:

*SFWMD issued a request for information on October 12, 2007 – They want **PTWCD
approval.

Canal Updates for 2007 Below
      CANAL UPDATE JUNE 2008

The long awaited approval from Pine Tree Water Management has come.  
However, one final stipulation from management was that Butler Farms execute
the cleaning of the storm sewers leading to canal drainage area.  Pillar
obtained 3 bids and submitted them to Board Members via email for voting.  
Several questions and concerns were raised with regard to variance in prices (
$14,293.60 / $8375.00 / $5895.00 ).  At the May monthly meeting it was
brought to our attention that The City does an annual cleaning of the storm
sewers.  A call placed to The City assured us that this expense/cleaning would
be covered by The City.

On May 12, the Board was sent a work authorization #05122008 for Additional
Work to Contract – to perform Construction Services.

Pillar Engineering was at our meeting to discuss the step by step construction
phase.

The Board did not sign the work authorization as our concerns were not
immediately answered.

Pillar will be receiving bids from competent construction companies within the
month.  After a careful review, by all parties, a company will be hired.  We then
will be at the mercy of the construction company to begin construction.

If you are a canal homeowner abutting the construction site please be aware
that the time is drawing near to have any and all structures / debris / trees
cleared away.  An official notice from Carvo & Emery attorneys will be sent out.
                                      June 2008...

As promised our engineering firm as secured 4 bids for our consideration for the
construction of the culvert.  Below is an updated  email from PILLAR that we want to pass
along to the concerned homeowners.

Yes, I have the bids.  However, something good has happened which will affect the bids.  

1.We followed up with the South Florida Water Management District regarding the status
of the permit.  They said it was APPROVED and is in processing.  We should receive it in
about a week.

2.We received confirmation from Broward County Water Resources Division that they are
not going to take jurisdiction over the project.  Therefore a permit is not necessary from
that department.  Additionally, they want us to remove the connection from Wiles Road
right of way to your culvert.  As a result we can eliminate one drainage structure and
approximately 355 feet of pipe.  This should save a considerable amount of money.

I would like your permission to revise the plans to remove the drainage structure and 355
feet of pipe and then send the plans back to the bidders for another price.  We will also
need to inform Pine Tree Water Control District of the change.  This can be accomplished
by submitting the revised plans to Warren Craven along with a letter of explanation.  
Please let me know if this is O.K. to do.

                         August 18, 2008 …
A Work Authorization was signed by our President which now authorizes PILLAR
Engineering to move forward with the construction phase.  Our choice of construction
company will now formulate a written agreement which must pass
Board/lawyer/Engineer approval. Baring any unforeseen problems we were given an
estimate for construction to begin within 45-60 days.  Canal homeowners will be
receiving a notice from Carvo & Emery with a 30 day timeframe to remove structures
and debris.  We know this has been a long ongoing project but please bear in mind that
this IS the final step in getting our culvert installed.  We do appreciate your patience.
                    August 2, 2008 …
The BOARD was not satisfied with the revisions as the bids were only estimates.  This is an open door
for change orders and addition charges.  We are requiring a firm proposal with contingency to cover
expenses that may be unforeseen.
                                          September 2008

After being given their signed work authorization, PILLAR Engineering, initiated contracts with our
choice of construction company, OMEGA.  We received OMEGA’s contract in late August.   Our legal
counsels reviewed the contract as well as all Board members.  Questions and concerns were
answered and on September 16, our President signed the construction contract.   This contract was
then sent back to OMEGA for final approval.  We should know within 2 weeks a time frame for
construction to begin – at which time – our website will update for concerned homeowners.
                                    OCTOBER CANAL UPDATE

Construction contracts have been executed by all parties.  Shop drawings have been
reviewed and completed by PILLAR.  The City permit application has been completed but
not submitted yet.  We had to submit to Broward County for a new license to construct the
outfall into the canal which is required as part of our submittal to the City.  This is our
second submission as our first permit expired due to the length of time it took to get
PTWCD issues resolved.  After the City permit application has been reviewed and ready
to be issued, a preconstruction meeting with the City will need to be held.  It will take about
4 weeks to manufacture the structures after the shop drawings have been approved.  
While all of this is going on, the contractor will be installing the Silt Fence, removing trees
and beginning the earthwork.  It will take another 4 – 6 weeks for the construction after the
structures and pipe are delivered to the site.

Taking holidays into account, we expect construction to be completed around January 31,
2009
                CANAL UPDATE NOVEMBER

At a recent meeting with the City of Coral Springs Code Division our lawyer and
construction phase.  After the City permit application is reviewed and issued, a pre
construction meeting with the City will be held.  We are still anticipating a January 31,
2009 finish date for the construction.
We have confirmation from OMEGA that they will be onsite the first of December.  

Set up of equipment and land prep should take approximately two days.

OMEGA will be digging / laying pipe / overfilling as they go along.  Our cement structure order
has been in progress for several weeks, therefore, as needed our structures will be dropped
shipped to location site as needed.

At this time ALL homeowners with bridges / trees / plantings etc that are encroaching on HOA
property should remove or have removed their personal property.

Should your debris not be removed each homeowner will be assessed a fee for their removal.  
Please act accordingly to keep this expense from incurring.

Please be advised that OMEGA will not be on site during the holidays from Dec. 23 – Jan 2.

Our January 31, 2009 deadline is our utmost goal to complete this project.
