TREASURERS REPORT:  End of January 2009
        Bank Atlantic – reg.  $83,071.43
        Bank Atlantic – assess  $153,734.01
        Bank of America – CD  $11,694.52
        Total paid for 2009 = 149
        Total unpaid for 2008 = 58
        1st payment made to Omega = $165,506.40
        11 returned 2009 1st letters / Robyn researched BCPA page via web and found 8 new / updated
addresses.  She readdressed & sent out to ho’s.

PRESIDENTS REPORT:

•        Diane read email from Bill Laystrom about legalities with regard to fences, feet of easement for ho’s on the
west end canal / construction area and also Associations responsibility for maintenance.
•        Diane read email from Jason (Pillar) regarding his answer to the Boards question as to who is liable for
watering the sod on the west end canal/ditch.  – answered – Omega has a watering truck which will water weekly
until sod “takes” – approximately one month.
•        The Board is concerned (safety) with the drainage grates on the west canal.  * Should we fence around the
four grates?  * Ask Jay/Jason (Pillar) what their past experience has been and any ideas?
•        The Board has to discuss and vote on the 35 foot easement in rear of ho’s property on the west end canal.  
The options would be to give 35 foot easement to ho’s for their own maintenance and ability to fence area – OR –
deny ho’s use of this easement.
•        Also – if the vote is to allow fencing, should ho’s place hedge covering inside or outside of fencing?



OLD BUSINESS:

NEW BUSINESS

•        Jerry to contact CPM – our east end signs are showing rust stains. Check chemicals/pump.
•        Jerry to check timer on Wiles Road lighting.  Reset if necessary.  Lights aren’t coming “on” early enough.
•        Diane to schedule closing with John @ Bank Atlantic for Sat. Feb 21st if possible, to sign loan papers for loan
modification to borrow an extra $100,000.00.  Board voted at Feb. 6, 2009 special meeting to extend our $165.00
special assessment for an additional one year to cover this loan modification.
•        Robyn spoke with John on Feb. 18, 2009 and he is unable to schedule closing for Saturday.  He is awaiting
an opinion letter from our attorney, Michael Emery, which needs to be included in our closing packet.
OPEN FLOOR DISCUSSION WITH HOMEOWNERS

1.        If ho’s are allowed to fence the 35 foot easement, the HOA should have access to drainage grates through
double wide (8 foot) gates placed on the west side of fencing – not – north /south side of fencing.
2.        Ho’s complained that the company watering the sod is using a “fire hose” and the pressure is getting the
back of homes/decks wet and muddy.  Robyn to call Pillar and address this problem.
3.        In general, ho’s are happy with the finished west end canal construction and are eager for final walk thru’s
/completion of permits and code compliance violation release.  Robyn to contact Pillar for timeframe.
4.        If homeowner does not fence and the Board denies the 35 foot non access easement to ho’s to fence in,  
what is CPM’s liability to maintain?


MOTION made by Jerry to allow ho’s the 35 foot non-access easement to fence in and maintain with appropriate
double gate ( 8 foot ) entry on west side of fencing.  Subject to legal counsel advice.
